Sewer backup in a Queens basement: what to do and who's responsible
Sewage coming up through a basement floor drain or toilet is a health hazard and a stressful mess. In NYC the next steps depend on one question: is the problem in the City's sewer or in your private line? Here's how that gets decided.

Emergency? Gas smell, CO alarm, fire, sparking or flooding: get to safety and call 911 first.
Right now
- Stop using water in the house, including toilets, sinks, the washer and dishwasher.
- Keep kids and pets away. Don't walk through sewage near outlets or appliances.
- Photograph and video everything for insurance.
- Report it to 311 (phone or online). Keep your 311 number and any DEP Customer Service Request (CSR) number.
What DEP does
DEP says it will inspect within six hours of a 311 complaint, though heavy rain or snowmelt can delay this. If the backup is in the City's sewer, DEP starts the repair. If DEP finds the problem is in your private sewer service line, you'll get a Notice to Repair.
Property owners own and are responsible for the sewer service line that connects the property to the City sewer main in the street. DEP's repair order notice says non-emergency repairs must be made within 30 days by a licensed master plumber, and emergencies immediately. Repairs may be covered by your homeowners insurance or by DEP's optional Service Line Protection Program if you're enrolled.
If you believe the City was at fault, DEP says to file a claim with the NYC Comptroller within 90 days.
Preventing the next one
- Backwater valve: lets wastewater flow out but not back in. A licensed plumber must install it. DEP's homeowner guide says installation typically costs $4,000 to $15,000 and takes 2 to 8 hours, depending on access to the house's sewer connection. After that, you maintain it.
- Downspouts tied into the sewer usually need to be disconnected when a backwater valve goes in (see our gutter guide).
- Keep grease, wipes and other solids out of drains.
- If your line backs up repeatedly in dry weather, ask a plumber about a camera inspection.
